Licensed Site Remediation Professionals (LSRP)
In New Jersey, environmental reforms for site remediation have a fairly recent history. It all started with the 2009 passage of the Site Remediation Reform Act (SRRA), which established affirmative obligation for responsible parties to remediate contaminated sites in a timely manner.
May 7, 2012, was also an important date that marked the end of the phase-in period for implementing the SRRA and related amendments to the Brownfield and Contaminated Sites Act, the Soil Compensation and Control Act, and the Industrial Site Recovery Act. This was the day that the symbolic “car keys” for all remediation were handed over to experts known as Licensed Site Remediation Professionals (LSRP) under the New Jersey Department of Environmental Protection (NJDEP). Going forward, all remediating parties were required to retain an LSRP and remediate their site under the new LSRP paradigm, regardless of when cleanup was initiated.
The SRRA also requires that LSRPs comply with all remediation statutes and rules, and that these individuals consider NJDEP-developed guidance when making decisions. For this reason, the NJDEP is still the final authority over environmental cleanup regulations; however, the point of working with an LSRP is to increase the pace of remediation.
The LSRP’s highest priority is the protection of public health and safety, as well as the environment. These individuals must meet rigorous standards for education, training and experience before receiving their license. LSRP licensing and performance standards are the responsibility of a 13-member Site Remediation Professional Licensing Board established under SRRA. Every LSRP is bound by a strict code of ethics, the violation of which could mean suspension or revocation of license.
The Board also requires that each LSRP earn 36 Continuing Education Credits (CECs) during the three-year term of his or her license. Of these 36 credits, a minimum of 14 must be technical, a minimum of 10 must be regulatory, and a minimum of 3 must be ethical.
